Are Police Tracking Your Phone?

Are police and local law enforcement tracking your cell phone use? That's what the A.C.L.U. wanted to know when they sent out letters probing over 350 local law enforcement agencies throughout the country Wednesday.

That includes three agencies right here in Nebraska -- the Omaha Police Department, the Lincoln Police Department and the Nebraska State Patrol.

"I do have a G.P.S. setting on my phone to where you can find me wherever I am,” said Ianshanae Harmon of Omaha.

Harmon and Marquisha Chandler are avid cell phone users, whether it's a text, phone call or using phone applications. But they are worried someone else is watching them.

Reporter asks, "Do you think police are doing that?" Marquisha Chandler says, "I think they do, I think they are because they are everywhere I go, but they don't really bother me."

It’s that same question A.C.L.U. in Nebraska is asking of three of the largest law enforcement agencies in Nebraska. They're asking if police are tracking us and what kind of information they're collecting from cell phone users.

In a letter addressed to Omaha Police Chief Alex Hayes, the A.C.L.U. is asking for information including, cell site triangulation and G.P.S. tracking, data retention policies and the use of cell phones location records to identify "communities of interest" in investigations.

Officer Jake Bettin with Omaha Police Department explains police protocol for cell phone tracking. "We are not allowed to obtain that information unless it is through a court order, so we really in those cases, apply for typically a search warrant to obtain that information, which a judge has to sign off on."

But that doesn't mean your information isn't vulnerable or more easily tracked by police, with some applications now using location services.

Ianshanae Harmon says, "When you allow it, it's easier it's faster, you are having fun but when you don't it's slow, it's irritating."

38 local A.C.L.U. affiliates sent out these letters as part of the organizations “Demand Yourdot Rights” campaign.

Amy Miller, the Director for A.C.L.U. Nebraska sent this statement, "We asked the three largest law enforcement agencies if they are keeping track of Nebraskans...if we learn they are, more requests will follow."

Officer Jake Bettin with the Omaha Police Department says only: "Chief Hayes has seen the letter, we will respond." Now what exactly that response will be, Bettin only said it's too soon to say.

Finally, if your kids have cell phones, make sure to keep an eye on their cell phone use. This also means paying attention to people who call their cell phones so you can find the owner of a phone number here if you encounter the number of a caller you do not recognize and want to learn their identities.
